Eligible Participants (“Participant(s)”)

Participation in the Promotion is only available to existing account customers of BlueScope Distribution Perth, who:

  • are business customers (i.e. corporate entities) not individuals (i.e. natural persons), and
  • have a registered delivery address(es) in Western Australia

Promotional Period

8:00am AWST on Wednesday 17th April 2024 to 4:30pm AWST on Friday 30th June 2024.

The Promotional Period may be extended at the sole discretion of the Promoter.

Claims received outside of the Promotional Period will not be accepted by the Promoter.

How to participate

To participate in the Promotion, a Participant must, during the Promotional Period:

(a)   purchase 25 tonnes or more of the following products in one or more transactions, with all such transactions being made on the same date:

  • BISALLOY® WEAR steel products
  • BISALLOY® STRUCTURAL steel products
  • A combination of BISALLOY® WEAR steel and BISALLOY® STRUCTURAL steel products (together, “Participating Products”), and

(b)   Satisfy the other eligibility and claim requirements as set out in these Terms and Conditions.

The Participating Retailer will validate the Participant’s order and satisfaction of other eligibility requirements in order to confirm the Participant’s eligibility for the Gift.

A Participant can choose one (1) of the following options:

All Gifts are valued at $500+gst

Gifts are not redeemable for cash.

Gifts are only available while stocks last. Participants acknowledge and agree that if any Gift (or part of any Gift) is unavailable, for whatever reason, the Promoter, in its discretion, reserves the right to substitute the Gift (or that part of the Gift) for a Gift of equal value and/or specification.

Allocation and receipt of Gift

A Participant will be allocated their Gift after the Participating Retailer determines that their order is valid and the Participant is eligible for a Gift. The Participating Retailer will then contact the Participant to confirm which Gifts are available and which Gift the Participant would like to choose.

The Gift will be delivered at time of eligible BISALLOY® steel order delivery OR within 30 days of order placement.

Limitation on Gifts

A limit of one (1) Gift per Participant applies.

 

PART A – INTRODUCTION

  1. By participating in the Promotion, Participants accept and agree to be bound by these terms and conditions. For the avoidance of doubt, these terms and conditions include the Schedule above.

  2. Participants must comply with these terms and conditions to participate in the Promotion. 

PART B – DATA COLLECTION AND PRIVACY

  1. The Promotor collects personal information (“PI”) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI.

  2. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at: https://cdn.dcs.bluescope.com.au/download/bluescope-privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning Participants. The Privacy Policy also contains information about how Participants may opt out, access, update or correct PI, how Participants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.

  3. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy).

  4. Participants consent to the Promoter using names, likenesses, images and/or voices relevant to them in the event they are a winner (including photographs, films and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

PART C – WHO CAN PARTICIPATE IN THE PROMOTION

  1. Related companies or agencies of the Promoter are not eligible to participate in the Promotion.

  2. Only business customers of the Participating Retailer are eligible to participate in the Promotion. Individuals (i.e. natural persons) are not eligible to participate in the Promotion.

  3. The Promotion is not available in conjunction with any other promotion or offer by the Promoter or any related body corporate.

PART D – HOW TO PARTICIPATE IN THE PROMOTION

  1. To participate in the Promotion, a Participant must comply with the ‘How to Participate’ section of the Schedule.

  1. The Promoter reserves the right, at any time, to request verification of the identity, business address or any other information relevant to participation in the Promotion of all Participants. The Promoter reserves the right to disqualify any Participant who provides false information or fails to provide information that is reasonably requested by the Promoter.

  2. The Promoter reserves the right, in its sole discretion, to disqualify any Participant who has:

    (a) provided incomplete, indecipherable and/or offensive material as part of their participation in the Promotion,

    (b) breached any of these terms and conditions; and/or

    (c) contravened any applicable laws or regulations or otherwise engaged in unlawful or improper conduct.

  1. The eligibility of Participants to receive a Gift is solely within the discretion of the Promoter.

  2. The Promoter accepts no responsibility for late, lost or misdirected communications.

  1. If participation in the Promotion is online, by telephone or SMS, the Promoter assumes no responsibility for any failure to receive any information or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security. If such problems arise, then the Promoter may modify, cancel, terminate or suspend the Promotion.

PART E – GIFTS 

  1. Each Gift is not transferrable, exchangeable or redeemable for cash.

  1. If any Gift is unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute the Gift with a gift of equal or greater monetary value. This right is subject to any applicable legislation, regulations or directions from a regulatory authority.

  1. Once the Gift has left the Promoter’s premises, the Promoter takes no responsibility for the Gift being damaged, lost or stolen.

  2. All taxes (excluding GST, if any) which may be payable as a consequence of receiving an Gift are the sole responsibility of each Participant.

  1. The Participant’s use of the Gift is entirely at their own risk. Before the Gift is provided, the receiver of the Gift may be required to sign an agreement to release the Promoter from and indemnifying the Promoter against any liability arising from or in connection with the Gift.

PART F – RECEIVING THE GIFT 

  1. Each eligible Participant during the Promotional Period will receive a Gift.

  2. The eligibility of Participants to receive the Gift is solely within the discretion of the Promoter.

  3. It is the responsibility of each Participant to comply with the Promoter’s instructions on how to receive their Gift as outlined in the “Receiving of Gifts” section of the Schedule.

  4. The Promoter reserves the right to request representatives of each Participant to provide proof of their identity and/or proof that they were responsible for participating in the Promotion.

  5. Each Participant agrees to participate and cooperate, as required, in all publicity activities relating to the Promotion, including, without limitation, its representatives being interviewed, photographed, filmed and recorded. Each Participant authorises the Promoter to use such content for advertising and publicity purposes in any media in perpetuity worldwide.

  6. It is the responsibility of each Participant to notify the Promoter of any change to their contact details.

PART G – NO LIABILITY

  1. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (including the Australian Consumer Law at Schedule 2 thereto), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).

  2. Subject to any liability that cannot by law be excluded, including as provided for under the Australian Consumer Law, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) shall not be liable and excludes all liability (including negligence), for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) for damage to property, personal injury or death suffered or sustained in connection with this Promotion or the use or taking of any Gift.

PART H – TERMINATION OF PROMOTION

  1. The Promoter reserves the right to vary the terms of, or cancel, the Promotion at any time without liability to any Participant or other person, subject to applicable laws.
